The “Decreto Salva Casa 2024” (Save the Home Decree 2024) introduces significant innovations in construction and urban planning, offering innovative solutions and simplifications for families, homeowners, and investors. Here’s a summary of the main measures:
1. New Construction Tolerances
The decree establishes new tolerance thresholds for construction discrepancies carried out by May 24, 2024, which will no longer require a building amnesty:
- 2% for units with a surface area greater than 500 sqm.
- 3% for surfaces between 300 and 500 sqm.
- 4% for surfaces between 100 and 300 sqm.
- 5% for surfaces between 60 and 100 sqm.
Dimensional reductions or the absence of non-structural architectural elements will also fall under executive tolerances.
2. Studio Apartment Habitability
The habitability requirements for studio apartments are being revised:
- 20 sqm for one person.
- 28 sqm for two people.
The minimum internal height decreases from 2.70 meters to 2.40 meters, provided ventilation and hygiene criteria are met. Exceptions apply to bathrooms, corridors, closets, and mountain areas above 1,000 meters.
3. Attics Made Habitable
It will become easier to make attics habitable, even when minimum distances between buildings are insufficient, provided:
- Regional laws are respected.
- The height and surface limits at the time of construction are adhered to.
4. Updates for Condominiums
Construction discrepancies in common areas will no longer prevent private apartment renovations and vice versa, simplifying both condominium-wide and individual renovation projects.
5. Expanded Free-Building Works
The list of works that can be carried out without prior permits is expanding to include:
- Installation of heat pumps up to 12 kW.
- Removal of architectural barriers.
- Installation of awnings and bioclimatic structures, provided they don’t create enclosed spaces.
6. Changes in Use
Changes in building use will be allowed if consistent with the building’s predominant use:
- Without structural work: Only a SCIA (Certified Start of Activity) will be required.
- With structural work: A building permit will be necessary.
7. Simplification of Penalties for Construction Violations
Procedures for rectifying building violations are becoming more flexible:
- The “double conformity” rule will no longer be required; compliance with the regulations in force at the time of the application will suffice.
- The SCIA in amnesty will involve a penalty equal to double the property’s value increase (minimum €1,032, maximum €10,328).
- Deadlines are extended: the time to remove violations will increase from 90 to 240 days in cases of economic or health difficulties.
